Who owns the translation memory, the client or the translation agency?

There have been a lot of interesting discussions about this topic. The translation agency is the one that produces translation memory or TM when they work on the translation task, but the client company pays for their work. Feel free to share your comments and answers here.

Thanks imperialcherry. However, the translation agency can just say that they have delivered what the client paid for which is the translated text. Translation memory is their own to keep and can be leveraged for future work with the same or other clients.

yes, you are right. In this circumstance, I think may be who translate the original document would own the TM.

I think the client owns the Translation Memory. When they give a project to a translation agency, they will give the relevant TM as well. Then, the project manager from the translation agency will analyse the file to find out how many perfect match, fuzzy match and new words respectively. Then, they will charge the client accordingly.
